Judge Tosses Blind Gamer’s Suit vs. Sony [Dismissed]

In October a visually-impaired gamer sued Sony , alleging that it wasn’t fulfilling its responsibilities under U.S. law to provide access to the disabled. The reasoning depending on finding that Sony’s products constitute a public accommodation . A judge said they aren’t. Plaintiff Alexander Stern sued Sony, Sony Computer Entertainment America and Sony Online Entertainment in federal court for the Central District of California, alleging that “his visual processing impairments prevent him from fully enjoying the video games manufactured by Sony, some of which are played on gaming systems with internet connections through which players in different locations can communicate and play with or against one another.” The court, in granting Sony’s motion to dismiss on Feb. 8, refused to go so far as to say any game Sony currently makes constitutes a public accommodation. A public accommodation doesn’t need to be publicly owned -very loosely speaking it can be a grocery store, hotel or office building whose use is generally available to the public. In a broad sense, we were talking about applying that standard to a virtual environment. So as you can imagine, allowing the suit to proceed on this finding would have wide ramifications for games publishers. Instead, the court found Sony “is not a place of public accommodation,” and therefore is not in violation of the Americans with Disabilities Act. Unreal Modders Win Awards, Don’t All Clone Gears of War…

What can a bunch of amateurs turn Unreal Tournament 3 into? The just-completed Make Something Unreal contest offered money in order to find some answers. One is the shot top this post, but that wasn’t the winner. Top honors went to a mod called The Haunted, a horror take on UT3, developed by a six-man crew and set for release as a standalone game. (Check out the official trailer .) The Make Something Unreal contest was launched in 2008, offering game modders four stages of competition and a split of $1 million in prize winnings. Intel and Unreal-makers Epic Games put on the competition. Last week, Epic Games vice president Mark Rein told Kotaku he was “blown away” by the quality of the submissions, feeling they compared well to many professional efforts he has seen. “People have risen to the occasion.” The contest promotes both Unreal Tournament 3 and the Epic-made Unreal Engine 3, the underlying graphics technology behind that game and so many other development studios’ projects. Rein said that in addition to promoting the game and the engine, he felt the contest was a good way to highlight the best people in the mod-making scene and reward them. “Modding is alive and well and a way for people to express themselves in game design, without building standalone games,” Rein said. he dismissed the notion that the closing off of major games such as Modern Warfare 2 to any sort of user-modifications could signal a decline in the opportunities for modders to do their thing. He doesn’t blame studios for not all offering mod-ready games. It’s a time-consuming and resource-draining proposition, he said, one that requires having a support staff for the modders and that could rob from the hours and effort needed to produce a game and its post-release downloadable content. “It’s different for us because we already have the engine business,” he said. Rein seemed particularly proud of the fact that not all of the winning entries to the Make Something Unreal contest look like games made in the Unreal Engine 3. He’s familiar with the knocks that a lot of UE3 games look like Gears of War clones, but he pinned that on creative decisions by other developers more-so than on technical restrictions of Epic’s engine. Anyone can take a look at the contest-winning entries to test that analysis. Or take another look at the mod pictured atop this post. The screenshot is from fifth-place finisher Hazard: The Journey of Life, which somehow mixes philosophy with a first-person perspective. For the first time, I took my taxes to a paid preparer. First thing tomorrow morning I meet with them to approve the documents. The anxiety I feel is absolutely the same as my parents getting my report card. Ordinarily I do my own taxes but because I’m filing in three different states for 2009, and two of them aren’t real clear about how I apportion personal business income (and f—- if California thinks it’s getting more than its cut of what I earned in January and February, which was peanuts), I figured I’d let a pro handle it. So far I’ve spent – I think – $300 to save $500, so I’m ahead. But then, I haven’t seen my final state tax bill yet. Anyway, it’s one for you, nineteen for me in Kotaku Off-Topic. Feel free to rant about the Taxman, the following subjects, or any other that come to mind. Ole Miss is holding a binding student committee vote to replace their Confederate colonel mascot. The leading candidate is said to be another rebel commander: Admiral Ackbar. Ding dong, the Hummer’s gone. A deal to sell off the mega-SUV brand to the Chinese fell apart and now it will be shut down altogether – a fate as ignominious as Oldsmobile’s. Good riddance. Conan O’Brien joins Twitter. It’s a verified account, ladies and gentlemen, and in two hours it more than doubled the followers for Jay Leno’s feed. Unless a lawyer’s reviewing each Tweet, I predict a messy head-on smackup involving impulsive instapublishing and nondisparagement severance clause. Some guy gets a tattoo of Ashton Kutcher’s face on his arm. Nuff said.
